These Terms and Conditions govern your use of the Mardock Business Consulting website and form part of the basis on which we provide consulting services. By accessing this website or engaging our services, you accept these terms. If you do not agree, please do not use this website or engage our services.
1. Definitions
In these Terms: "Mardock", "we", "our" means Mardock Business Consulting, operating from 22/F, Pacific Place Three, 1 Queen's Road East, Admiralty, Hong Kong. "Client", "you" means the individual or company engaging our services or accessing this website. "Services" means the consulting programmes and advisory services offered by Mardock. "Engagement Letter" means the written scope document agreed and signed before any engagement commences.
2. Website Use
This website is provided for informational purposes. The content is intended for business professionals in Hong Kong and does not constitute financial, legal, or investment advice.
- You may use this website for lawful purposes only.
- You may not attempt to gain unauthorised access to any part of the website or its underlying systems.
- You may not use automated tools to scrape, harvest, or republish content from this website without our written consent.
- We reserve the right to restrict or terminate access to the website at any time without notice.
3. Consulting Services
All consulting engagements are governed by a separate Engagement Letter, which specifies the scope, deliverables, timeline, fee, and any special terms applicable to that engagement. In the event of a conflict between these Terms and the Engagement Letter, the Engagement Letter takes precedence.
Services described on this website are indicative. The precise scope of any engagement is agreed in writing before work commences. We reserve the right to decline any enquiry or engagement at our discretion.
4. Fees and Payment
Fees for each programme are as stated in the Engagement Letter. Unless otherwise specified:
- Fixed-term programmes are invoiced at the start of the engagement, with payment due within 14 days of invoice.
- Monthly advisory engagements are invoiced at the start of each calendar month.
- Fees are stated in Hong Kong Dollars (HKD) and are exclusive of any applicable taxes unless stated otherwise.
- Late payment may result in suspension of services. We reserve the right to charge interest on overdue amounts at a rate of 1.5% per month.
5. Cancellation and Termination
For fixed-term programmes: If you cancel after work has commenced, fees for work completed up to the cancellation date are payable in full. If we are unable to commence due to our own circumstances, any fees paid in advance will be refunded in full.
For monthly advisory engagements: Either party may terminate with 30 days' written notice. Fees for the notice period are payable in full regardless of whether services are utilised during that period.
We may terminate an engagement immediately if a client acts in bad faith, fails to provide information reasonably required for the work, or breaches these Terms or the Engagement Letter.
6. Confidentiality
We treat all client information as confidential and will not disclose it to third parties without your consent, except where required by law or regulatory authority. Specific confidentiality obligations are set out in the mutual NDA signed at the start of each engagement.
Information you submit via the contact form on this website is handled in accordance with our Privacy Policy.
7. Intellectual Property
All content on this website — including text, design, structure, and graphics — is owned by or licensed to Mardock. You may not reproduce, distribute, or use website content for commercial purposes without prior written consent.
Deliverables produced as part of a consulting engagement (documents, templates, reports) become the property of the client upon full payment of fees. Mardock retains the right to use anonymised, aggregated insights from engagements for internal development and methodology improvement.
8. Limitation of Liability
Mardock provides consulting advice and deliverables based on information available at the time of the engagement. We do not warrant that outcomes will meet specific financial or operational targets, and outcomes depend on factors outside our control.
To the fullest extent permitted by Hong Kong law, Mardock's aggregate liability to a client for any claim arising from a specific engagement is limited to the total fees paid by that client for the relevant engagement. We exclude liability for indirect, consequential, or speculative losses.
Nothing in these Terms limits liability for fraud, wilful misconduct, or liability that cannot be excluded by law.
9. Indemnity
You agree to indemnify Mardock against any claims, losses, or expenses arising from your misuse of this website, your breach of these Terms, or any inaccurate or misleading information you provide to us in the course of an engagement.
10. Third-Party Links
This website may contain links to third-party websites. These are provided for convenience only. We do not endorse, control, or accept responsibility for the content or practices of linked sites.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Hong Kong Special Administrative Region. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
12. Changes to These Terms
We may update these Terms from time to time. The date at the top of this page reflects the most recent version. Continued use of this website after changes are posted constitutes acceptance of the updated Terms.
